This Privacy Policy (this “Policy”) describes how Softvivor, Inc. (the “Company,” “Softvivor,” “we,” “us,” or “our”) collects, uses, discloses, and otherwise processes information relating to identified or identifiable individuals (“personal information” or “personal data”) in connection with your access to and use of the website located at softvivor.com (the “Website”). This Policy is designed to meet high-standard privacy requirements and is drafted to align with the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA), as well as the EU General Data Protection Regulation (GDPR) for visitors located in the European Economic Area (“EEA”), the United Kingdom, and other jurisdictions with similar requirements.

Section 1

Scope and Context (Corporate Showcase Website)

1.1 Corporate Website Only. The Website is a corporate showcase / informational landing site. The Website does not provide user accounts, log-in functionality, subscription dashboards, e-commerce checkouts, or payment processing features.

1.2 No Payment Data on Softvivor.com. Softvivor.com does not collect or store payment card details, bank account details, or other financial account credentials. If you navigate to other websites (including websites of Softvivor-affiliated brands) that may process payments, your use of those websites and any payment processing are governed by the applicable terms and privacy policies of those websites (see also Section 1.4 and Part 2 for link-related disclosures).

1.3 Visitors Covered. This Policy applies to information processed about:

  • visitors who browse the Website;
  • individuals who contact us via the Website’s “Contact Us” form or similar communication channels; and
  • individuals whose device identifiers, cookie identifiers, or online activity information are processed through cookies and similar technologies used on the Website.

1.4 Third-Party Sites and Liability Separation. The Website may contain links to external sites, including domains operated by Softvivor-affiliated brands (for example, payment-enabled domains). This Policy applies only to softvivor.com. We are not responsible for the privacy practices of external sites, and we encourage you to review the privacy policies of those sites before providing information or making purchases.

Section 2

Definitions (Plain-Language and Legal Meaning)

For purposes of this Policy:

  • “Personal Data” / “Personal Information” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with an individual or household.
  • “Processing” means any operation performed on personal data, such as collection, use, storage, disclosure, or deletion.
  • “Cookies” are small text files stored on your device or browser that enable or enhance Website functionality and analytics.
  • “Tracking Technologies” include cookies, pixels, tags, SDKs, local storage, and similar technologies used to recognize a device or browser over time and across webpages.
  • “Contact Form Data” means the information you provide through our Website’s contact form, such as your name and contact details, and any message you include.

Where the GDPR applies, references to “personal data” include the meaning set forth in Article 4(1) GDPR. Where the CCPA/CPRA applies, references to “personal information” include the meaning set forth in Cal. Civ. Code § 1798.140.

We collect information in two primary ways: (A) information you provide to us directly, and (B) information collected automatically through cookies and similar technologies when you interact with the Website.

3.1 Information You Provide Directly (Contact Us Form). When you submit an inquiry via the Website, we may collect:

  • Identifiers and Contact Details: name, surname (if provided), email address, phone number.
  • Inquiry Content: any information you choose to include in the message field (for example, a description of your request, project context, or business needs).

Important Notice (Data Minimization): We request that you do not submit sensitive personal information through the contact form, including but not limited to government identification numbers, financial account information, payment card numbers, passwords, one-time codes, or health information. If you include such information in your message, you do so at your own discretion and risk; however, we will take reasonable steps to handle it in a manner consistent with this Policy and applicable law.

3.2 Information Collected Automatically (Cookies, Pixels, and Similar Technologies). When you visit the Website, we and our service providers may automatically collect certain information about your device and how you interact with the Website, including:

Key points:

  • Meta may receive information about your interaction with our Website via the Pixel.
  • This may enable measurement, attribution, and (depending on your settings and Meta’s products) the creation of audiences and delivery of ads.

4.4 Your Choices and Cookie Controls. Browser Controls. Most browsers allow you to manage cookies through settings (e.g., block or delete cookies). If you block or delete cookies, some Website features may not function properly, and analytics/measurement may become less accurate.

Cookie Banner / Preference Tool (If Implemented). Where required by law or where we choose to provide enhanced controls, we may present a cookie banner or preference management tool that allows you to accept, reject, or customize non-essential cookies.

Do Not Track / Global Privacy Control (GPC). Some browsers or extensions enable signals such as “Do Not Track” or the Global Privacy Control (GPC). Our handling of such signals may be described further in Part 2, including how we treat opt-out preference signals under applicable California law where relevant.

Purposes for Using Personal Data (Why We Process Data)

We use the limited information we collect for the following purposes:

5.1 Responding to Inquiries and Communications (Contact Form). We use Contact Form Data to respond to your messages and requests; communicate with you about your inquiry (including scheduling a call or requesting clarification); route your request internally to the appropriate team; and maintain basic records of business communications.

5.2 Operating and Improving the Website (Analytics and Performance). We use automatically collected information (e.g., technical and usage data) to operate, maintain, and secure the Website; monitor Website performance and diagnose technical issues; and understand visitor engagement (e.g., most visited pages) and improve content and usability.

5.3 Marketing Performance and Attribution (Meta Pixel). Where permitted by applicable law and depending on cookie settings/consent, we measure the performance of our marketing campaigns; understand whether visitors arrived via advertisements and what content is effective; and improve our marketing efficiency and messaging relevance.

5.4 Security, Fraud Prevention, and Protection of Rights. We may use information to protect the Website and users from malicious or unauthorized activity; detect, investigate, and prevent security incidents; enforce our Terms of Use; and protect our legal rights.

5.5 Compliance with Legal Obligations. We may process information as necessary to comply with applicable laws, lawful requests, and legal processes; respond to regulatory inquiries; and establish, exercise, or defend legal claims.

Sharing and Disclosure of Personal Data

6.1 No Sale of Personal Information. Softvivor does not sell personal information as that term is defined under the CCPA/CPRA. We do not exchange personal information for monetary consideration.

6.2 No Cross-Context Behavioral Advertising by Softvivor.com. Softvivor.com does not operate a logged-in advertising platform or user profiling system. Any marketing or advertising measurement conducted through cookies or pixels is limited to performance measurement and attribution as described in Part 1 and is subject to applicable consent and opt-out requirements.

6.3 Service Providers and Processors. We may share personal data with trusted third-party service providers that perform services on our behalf and under our instructions, such as:

  • website hosting and infrastructure providers;
  • analytics and measurement providers (e.g., Google Analytics);
  • marketing and attribution providers (e.g., Meta/Facebook);
  • email and communication service providers;
  • security and IT service providers.

These service providers are contractually required to process personal data only for specified purposes, to maintain appropriate security measures, and to comply with applicable data protection laws.

6.4 Legal and Regulatory Disclosures. We may disclose personal data where we believe disclosure is necessary to:

  • comply with applicable law, regulation, subpoena, court order, or other legal process;
  • respond to lawful requests from public authorities;
  • protect the rights, property, or safety of Softvivor, our users, or others; or
  • investigate or prevent suspected fraud, security incidents, or violations of our Terms of Use.

6.5 Business Transfers. In the event of a merger, acquisition, reorganization, sale of assets, or similar transaction, personal data processed through the Website may be transferred as part of that transaction, subject to appropriate confidentiality and data protection safeguards.

Section 7

International Data Transfers

7.1 United States-Based Operations. Softvivor is headquartered in the United States, and information collected through the Website may be processed and stored on servers located in the United States or other jurisdictions where Softvivor or its service providers operate.

7.2 Transfers from the EEA/UK. For visitors located in the European Economic Area or the United Kingdom, personal data may be transferred outside those regions, including to the United States. Where required by applicable law, such transfers are safeguarded using appropriate mechanisms, such as Standard Contractual Clauses approved by the European Commission or other lawful transfer mechanisms recognized under applicable data protection laws.

7.3 Risk Acknowledgment. You acknowledge that data protection laws in jurisdictions outside your country of residence may differ, and that your information may be subject to access requests from governmental authorities in accordance with applicable law.

Data Retention

8.1 General Retention Principle. We retain personal data only for as long as reasonably necessary to fulfill the purposes described in this Policy, unless a longer retention period is required or permitted by law.

8.2 Indicative Retention Periods:

  • Contact Form Data: retained for the duration necessary to respond to your inquiry and for a reasonable period thereafter for record-keeping and follow-up, unless you request deletion earlier or legal obligations require longer retention.
  • Analytics and Cookie Data: retained in accordance with the configuration of the relevant analytics or advertising tools and our legitimate business needs, subject to applicable consent and opt-out requirements.

8.3 Deletion and Anonymization. When personal data is no longer needed, we take reasonable steps to securely delete or anonymize it in accordance with our internal retention practices and applicable law.

Data Security

9.1 Security Measures. We implement reasonable and appropriate technical and organizational measures designed to protect personal data against accidental or unlawful destruction, loss, alteration, unauthorized disclosure, or access. These measures may include access controls, encryption, network security practices, and internal policies governing data handling.

9.2 No Absolute Security Guarantee. Despite our efforts, no method of transmission over the internet or method of electronic storage is completely secure. We cannot guarantee absolute security of personal data.

9.3 User Responsibility. You are responsible for ensuring that any information you choose to submit through the Website is provided securely from your own environment and does not include information you are not legally permitted to share.

Your Rights Under GDPR (EEA/UK and Similar Jurisdictions)

If you are located in the EEA, the UK, or another jurisdiction that provides similar rights, you may have the following rights, subject to applicable conditions and limitations:

  • 10.1 Right of Access. To request confirmation of whether we process your personal data and to obtain a copy of that data.
  • 10.2 Right to Rectification. To request correction of inaccurate or incomplete personal data.
  • 10.3 Right to Erasure (“Right to Be Forgotten”). To request deletion of your personal data where permitted by law.
  • 10.4 Right to Restrict Processing. To request that we limit the processing of your personal data in certain circumstances.
  • 10.5 Right to Data Portability. To receive your personal data in a structured, commonly used, and machine-readable format, and to request its transfer to another controller where technically feasible.

  • 10.7 Rights Related to Automated Decision-Making. Softvivor.com does not engage in automated decision-making or profiling that produces legal or similarly significant effects within the meaning of Article 22 GDPR.

California Privacy Rights (CCPA/CPRA)

If you are a California resident, you have the following rights under the CCPA/CPRA, subject to applicable exceptions:

  • 11.1 Right to Know. You have the right to request information about the categories of personal information we have collected, used, disclosed, or shared about you during the preceding 12 months.
  • 11.2 Right to Delete. You have the right to request deletion of personal information we have collected about you, subject to certain legal exceptions.
  • 11.3 Right to Correct. You have the right to request correction of inaccurate personal information.
  • 11.4 Right to Opt Out of Sale or Sharing. Softvivor does not sell personal information. To the extent any processing could be considered “sharing” under CPRA for advertising measurement purposes, you may exercise your right to opt out using available cookie controls or by contacting us as described below.
  • 11.5 Right to Limit Use of Sensitive Personal Information. Softvivor.com does not intentionally collect or use sensitive personal information as defined under CPRA.
  • 11.6 Non-Discrimination. We will not discriminate against you for exercising any of your California privacy rights.
  • 11.7 Authorized Agents. You may designate an authorized agent to make requests on your behalf, subject to verification requirements.

Exercising Your Privacy Rights

Section 13

External Domains and Affiliated Brands (Clarification of Scope)

13.1 Separate Domains, Separate Policies. Softvivor may operate or be affiliated with other brands and domains that provide products or services (including domains that process payments). Each such domain maintains its own privacy policy and data practices.

13.2 No Financial Data on Softvivor.com. Softvivor.com does not collect, store, or process payment information. Any financial data you provide on other domains is governed by the privacy policy and terms of those domains, not this Policy.

Section 14

Children’s Privacy

The Website is not directed to individuals under the age of 18, and we do not knowingly collect personal data from children. If you believe that a child has provided personal data through the Website, please contact us so that we can take appropriate steps to delete the information.

Section 15

Changes to This Privacy Policy

We may update this Policy from time to time to reflect changes in our practices, technologies, legal requirements, or business operations. When we do, we will update the “Last Updated” date at the top of this Policy. Continued use of the Website after changes become effective constitutes acceptance of the updated Policy.
